Nowa lista SOL została ogłoszona

17 maja 2010 australijski urząd imigracyjny ogłosił nową listę zawodów poszukiwanych tzw. Skilled Occupation List, na podstawie której będzie można aplikować o wizy stałego pobytu. Urząd przewiduje, że lista zacznie obowiązywać od 1 lipca 2010.  

Nowa lista odnosi się do tzw. independent migration, czyli emigracji bez sponsoringu. Istnieje także możliwość aplikowania o wizę stałego pobytu na podstawie sponsoringu przez pracodawcę.

Aplikanci posiadający uznany, przez odpowiednią australijską instytucję, zawód i doświadczenie zawodowe oraz odpowiedni okres pracy w danym zawodzie i spełniający wszelkie inne warunki związane z wizą stałego pobytu będą mogli aplikować o wizę stałego pobytu na podstawie nowej listy SOL. 
 
New Skilled Occupation List dostępna jest na stronie urzędu imigracyjnego w New List of Skilled Occupations Intended to Replace the Current Skilled Occupation List.
 
Urząd imigracyjny wprowadził specjalne okresy przejściowe dla osób które przed lub w dniu 8 lutego 2010 r. posiadały wizę studencką odpowiedniej subclass lub aplikowały czy też posiadają wizę subclass 485. Are there any proposed transitional arrangements?
The government recognises that the introduction of a new SOL would affect some international students who are currently studying in Australia and who intend to apply for a permanent residence visa at the completion of their studies.
For this reason, subject to the approval of the Governor-General in Council of the proposed legislative amendments, it is intended that a number of transitional arrangements would be introduced to minimise the impact of this change on international students.
It is proposed that the new list of occupations would not apply to any valid GSM applications already lodged before the date of implementation. It is also proposed that it would not apply to people who, on 8 February 2010:
- held a subclass 485 (skilled graduate) visa or
- had a pending subclass 485 visa application 
and who apply for a provisional or permanent onshore GSM visa before 31 December 2012.
Further, it is intended the new list of occupations would not apply to international students who, on 8 February 2010 held:
- a subclass 572 (vocational education and training sector) visa;
- a subclass 573 (higher education sector) visa; or
- a subclass 574 (postgraduate research sector) visa.
when they apply for a subclass 485 (skilled graduate) visa before 31 December 2012.
This would enable these students to remain in Australia for 18 months on the temporary skilled graduate visa after the completion of their studies to gain valuable work experience and the opportunity to secure an employer or state/territory government to sponsor them.
Subject to the approval of the Governor-General in Council, the government intends to establish these very generous transitional arrangements to allow most overseas students affected by this change time to remain in Australia temporarily while considering their options. If they cannot meet the requirements for a further visa to allow them to stay in Australia, they would be expected to leave Australia.
 
Osoby które do dnia lub w dniu 8 lutego 2010 roku posiadały lub oczekiwały o wydanie wizy subclass 485 będa mogły aplikować o wizę stałego pobytu na podstawie aktualnej listy SOL do 31 grudnia 2012 roku, jeżeli spełnią wszystkie wymagane warunki związane ze złożeniem aplikacji o tą wizę. 
 
Studenci posiadający w dniu 8 lutego 2010 roku odpowiednią wizę studencką będą mogli aplikować o wizę subclass 485 do końca 31 grudnia 2012 roku, jeżeli spełnią wszystkie wymagane warunki związane ze złożeniem aplikacji o tą wizę. Jednak aplikację o wizę stałego pobytu będą mogli złożyć tylko na podstawie nowej, właśnie ogłoszonej listy SOL lub gdy mają pracodawcę sponsora. 
 
Przypominany że od połowy tego roku planowane jest także wprowadzenie zmian dotyczących całego programu emigracyjnego. Samo posiadanie zawodu na liście zawodów pozyskiwanych nie wystarcza do tego by aplikować o wizę stałego pobytu.
